Terms of Service

The terms on which SkinPassport is provided, including what the analysis does and does not tell you.

These terms apply to the SkinPassport app and to skinpassportapp.com, together “the Service”. The Service is provided by [LEGAL ENTITY], [REGISTERED ADDRESS] (“we”, “us”).

By using the Service you agree to these terms. You may stop using the Service at any time by deleting your account, which the Profile tab does in one step. Sections listed in section 15 continue to apply afterwards.

Nothing in these terms excludes or restricts any right you have under mandatory consumer protection or data protection law. Where a provision here conflicts with such a right, that right prevails and the remainder of the provision continues to apply.

1. The Service

SkinPassport reads the ingredient list of a cosmetic product, identifies the ingredients, describes their general function, and compares the formulation with a skin profile that you enter. The analysis runs on your device. Your account, history and the product catalogue are held on our servers.

2. What the analysis does not tell you

SkinPassport is not a medical device and does not provide medical advice. It does not diagnose, treat, cure or prevent any condition, and it is not a substitute for advice from a doctor, dermatologist or pharmacist.

A score indicates how a formulation compares with the profile you entered. It is not an assessment of whether a product is safe for you, whether you will react to it, or whether it will be effective.

3. Eligibility

The Service is intended for users aged 16 and over. By using it you confirm that you meet that age requirement and have the legal capacity to accept these terms.

4. Your account

The app creates an anonymous account on first launch. You are not required to register or to provide an email address. You may subsequently add an email address or an Apple ID so that your data is available on another device.

You are responsible for use of the Service through your account and for the accuracy of the information you enter. The analysis depends on that information.

You may delete your account at any time from the Profile tab. Deletion is immediate and cannot be reversed.

5. Subscriptions and payment

Some features are free and others require a paid subscription, SkinPassport Pro.

No subscription is currently offered and no payment is currently taken. The paywall in the pre-release build is a prototype. This section applies from the date subscriptions become available, and the prices shown in the app at that time apply.

Subscriptions are sold and billed by Apple through the App Store or by Google through Google Play, under their terms. Accordingly:

  • Payment, renewal and price changes are administered by the relevant store.
  • Subscriptions renew automatically until cancelled.
  • Cancellation is made through your App Store or Google Play account settings. The app links to those settings. Removing the app does not cancel a subscription.
  • Refunds for store purchases are administered by the relevant store under its policies. This does not affect any statutory right to a refund or to cancel.
  • Where a free trial is offered, it converts to a paid period unless cancelled before the trial ends.

We do not receive or hold your payment details. Prices and the contents of the free tier are shown in the app before purchase and may change, but a change does not apply to a period already paid for.

5.1 Right of withdrawal (EU, EEA and UK consumers)

You generally have 14 days to withdraw from a distance contract without giving a reason. That right may end earlier where you expressly request that provision of the digital service begins during the withdrawal period and acknowledge that you lose the right by doing so. This right applies in addition to the store refund processes described above. To exercise it, write to hello@skinpassportapp.com.

6. Acceptable use

You must not:

  • use the Service in breach of any applicable law;
  • extract the catalogue, the ingredient database or any substantial part of either by automated means, including scraping and crawling;
  • use content obtained from the Service to build or populate another product or database;
  • circumvent usage limits, access controls or authentication;
  • interfere with the operation of the Service or attempt to access data belonging to other users;
  • submit content that you have no right to submit, or that is unlawful; or
  • reverse engineer or decompile the app, except to the extent that applicable law expressly permits it.

We may suspend or terminate access where these terms are breached.

7. Content you submit

If you submit a product, an ingredient, a correction or a suggestion, you confirm that you are entitled to submit it and that it is accurate so far as you are aware.

You retain your rights in the material. You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, store, adapt and publish it as part of the Service, including in the catalogue and the ingredient database, for as long as is reasonably necessary to operate, maintain and promote the Service. No payment is due for it.

Personal data contained in a submission is handled in accordance with the Privacy Policy and is not published by virtue of this licence. Where product or ingredient information from a submission is incorporated into the catalogue, it is held without any identifier and deletion of your account does not remove it.

We are not obliged to use, retain or respond to a submission, and may edit or remove it.

8. Intellectual property

The app, the website, their design, the SkinPassport name and logo, the scoring methodology, the ingredient descriptions and the selection and arrangement of the catalogue are owned by us or our licensors and are protected by copyright, trade mark and database rights.

You are granted a personal, revocable, non-transferable and non-exclusive licence to use the Service for your own non-commercial purposes. You may share individual results. You may not republish the ingredient database or the catalogue in whole or in substantial part.

Product and brand names are used for identification only and do not indicate any association with or endorsement by their owners.

Ingredient names are taken in part from CosIng, the European Commission’s cosmetic ingredient database, used in accordance with the Commission’s reuse policy. Product information is taken in part from Open Beauty Facts, which is published under the Open Database License. Neither source endorses SkinPassport or is responsible for our use of the data.

The Service may link to websites operated by others, for which we are not responsible.

10. Privacy

Personal data is processed as described in the Privacy Policy, which forms part of these terms.

11. Availability and changes to the Service

We do not guarantee that the Service will be available without interruption. It may be unavailable during maintenance, or for reasons outside our control.

We may add, change or withdraw features. Where a change materially reduces the features covered by a subscription during a period you have paid for, you may cancel and seek a refund through the store you purchased from.

12. Disclaimer

To the fullest extent permitted by applicable law, and without affecting your statutory rights as a consumer, the Service is provided “as is” and “as available”, without warranty as to accuracy, completeness, fitness for a particular purpose or non-infringement.

The following limitations apply to the analysis:

  • Text recognition from a photograph is not always accurate, particularly where print is small, curved or low in contrast. The app indicates which ingredients it resolved and does not produce a score where too little of a formulation is recognised.
  • Product records may be out of date, as manufacturers reformulate products without notice. The ingredient list on the packaging takes precedence over our record of it.
  • Ingredient descriptions concern the general function of an ingredient, and not its effect on an individual. Concentration, formulation and the other ingredients present all affect the outcome and are not apparent from an ingredient list.

You should carry out a patch test before using a new product, and consult a qualified clinician about any skin condition, allergy or adverse reaction.

13. Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence and for fraud or fraudulent misrepresentation. Your statutory rights as a consumer are not affected.

Subject to that, and to the fullest extent permitted by applicable law, we are not liable for indirect or consequential loss, for loss of profit, revenue, data or goodwill, for decisions taken about purchasing or using a product on the basis of the analysis, or for a reaction to a product.

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or in connection with the Service is limited to the greater of the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim and 50 EUR.

14. Indemnity

You will indemnify us against claims, losses and reasonable legal costs arising from your use of the Service in breach of these terms, from content you have submitted, or from your infringement of the rights of a third party. This does not apply to the extent that the claim arises from our own act or omission.

15. Termination

You may end these terms by deleting your account. We may suspend or terminate your access where you breach these terms, where we are required to do so by law, or where we cease to provide the Service, in which case we will give such notice as is reasonably practicable.

Sections 7, 8, 12, 13, 14, 17 and 18 continue to apply after termination.

16. Changes to these terms

We may amend these terms. The date at the top is the date of the current version. Where an amendment materially affects your rights, we will notify you in the app before it takes effect. Continued use of the Service after that date constitutes acceptance of the amended terms.

17. Governing law and disputes

These terms are governed by the law of [JURISDICTION], and the courts of [JURISDICTION] have jurisdiction. If you are a consumer, you retain the protection of the mandatory law of your country of residence and may bring proceedings before your local courts.

If you have a complaint, please contact hello@skinpassportapp.com so that we can try to resolve it. This does not restrict your right to bring a claim or to use any alternative dispute resolution or ombudsman scheme available to you.

18. General

If a provision of these terms is held to be unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor of the business.

These terms and the Privacy Policy constitute the entire agreement between you and us in relation to the Service.
